As we face an onslaught of unprecedented illegal attacks by the Department of Justice and the Department of Homeland Security, I reviewed FOIA results from my past work.
Below are two results:
First, one can see the genesis of how former Immigration Judge Stuart V. Couch defied binding precedent set forth in Matter of A-R-C-G, 26 I&N Dec. 388 (BIA 2014) and directly collaborated with former EOIR director James McHenry. This was the beginning of the end for A-R-C-G.
Second, under the first Trump administration, one can see how former EOIR director James McHenry, chose to appoint the likes of Stuart Couch, William Cassidy, and Earle Wilson to the BIA:
